laws of State of Idaho, United States of America,
notwithstanding any principles of conflicts of law. You
specifically consent to personal jurisdiction in State of Idaho

the subject matter hereof. The parties to these Terms of Use
each agree that the exclusive venue for any dispute between

content providers, service providers, employees, agents,
officers, directors, and contractors (the "Indemnified
Parties") from any breach of these Terms of Use by
you.
4. You certify that you will NOT use any form of
SPAM techniques, as outlined by the CAN-SPAM Act, to market
your podcasts. You further certify that, if a SPAM complaint
is received and has been caused by your activities,
NANACAST.COM AND INTERNET BUSINESS IDEAS INC. retains the right to: i. cancel your publishing,
ii. remove all podcasts, iii. sue you for damages attributed
to your actions, iv. provide any legal authority access to
details of the SPAM infraction. Failure to use one of these
discretionary rights is NOT a guarantee that it will not be
used in the future.
5.I
authorize NANACAST.COM AND
INTERNET BUSINESS IDEAS INC to share my contact information with the
publishers of private label our sister sites that are part of the network owned by and associated with Nanacast.com and Internet Business Ideas Inc. for payment
purposes only. I understand that this is to enable publishers
of sister sites, private labels, and associated networks, whose affiliate program I have joined, to send
me commission payments.
Although under no obligation to
do so, NANACAST.COM AND INTERNET BUSINESS IDEAS INC. reserves the right to monitor the
use of this site to determine compliance with these Terms of
Use, as well the right to remove or refuse any information for

SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, DIRECTORS, AND
CONTRACTORS (THE "INDEMNIFIED PARTIES") HARMLESS SHOULD YOU
ATTEMPT TO OPERATE OUTSIDE OF THESE TERMS OF
SERVICE.

AFFILIATE FOR PODCASTS PUBLISHED BY NANACAST.COM AND INTERNET
BUSINESS IDEAS INC. AND
ITS PUBLISHERS.
The following are terms and conditions for joining and
promoting affiliate programs for podcasts offered by
NANACAST.COM AND INTERNET BUSINESS IDEAS INC. and its publishers. If
NANACAST.COM AND INTERNET BUSINESS IDEAS INC. is the
actual publisher of a particular podcast, then these terms
apply. They DO NOT apply to any affiliate relationship having
to do with promoting NANACAST.COM AND INTERNET BUSINESS IDEAS
INC. itself.
1. I understand that affiliate commissions are paid by the
podcast owner, and not by NANACAST.COM AND INTERNET BUSINESS
IDEAS INC.. I
understand and agree that Livemark Associates, L.L.C.. and
NANACAST.COM AND INTERNET BUSINESS IDEAS INC.shall not be held liable for any
commissions earned or recorded by my promotion of podcasts
published by independent publishers using the NANACAST.COM AND
INTERNET BUSINESS IDEAS INC.system. I agree that I shall consider my
promotion of each podcast and podcast publisher a private
relationship between myself and the podcast publisher and that
any financial agreements including commissions offered and
paid are part of that private business relationship between
the podcast publisher and myself only. I also understand that
NANACAST.COM AND INTERNET
BUSINESS IDEAS INC. do not
offer, imply, or provide any compensation or commissions for
affiliate sales of podcasts and that such compensation or
commissions will be provided directly by the podcast owner. I
agree to contact the podcast owner concerning any questions
regarding commissions being offered, payout schedules, and
disputes.
2. I authorize NANACAST.COM
AND INTERNET BUSINESS IDEAS INC. to share my contact information with the
publisher for payment purposes. I understand that this is to
enable publishers who's affiliate program I have joined to
send me commission payments.
3. I understand that if I have any questions about
promoting a podcast or accounting issues related to that
podcast I am to contact the publisher directly and that
NANACAST.COM AND INTERNET
BUSINESS IDEAS INC. do not
represent the publisher of a podcast.
4. I understand that, as an affiliate of a podcast, any
promotion, earnings, or other issues regarding my affiliate
account and commissions owed by a podcast publisher are to be
resolved between myself (the affiliate) and the podcast
publisher. I agree to hold NANACAST.COM AND INTERNET BUSINESS IDEAS INC.without fault or liability and am
entering into this affiliate relationship with the podcast
publisher of my own free will and choice and by doing so
dismiss NANACAST.COM AND
INTERNET BUSINESS IDEAS INC.of all liability or damages that may result in
the course of my relationship with the publisher and promoting
their podcast. I also understand that by applying to become an
affiliate of individual publishers and by promoting their
podcasts, I am entering into a private relationship between
myself as an affiliate and the podcast publisher. I agree to
release NANACAST.COM AND
INTERNET BUSINESS IDEAS INC.of any liability against any claims that
should result of my private and independent relationship with
the podcast publisher as an affiliate.
5. No affiliate may purchase our products or services or
the products and services of our publishers through their own
link. If an affiliate is discovered to have joined as an
affiliate for the purpose of purchasing goods and services
from /or NANACAST.COM AND
INTERNET BUSINESS IDEAS INC., or from our publishers they will not be paid
the commissions from that sale. In the most extreme cases, if
it appears that an affiliate has attempted to circumvent this
agreement, registered for the affiliate program specifically
to purchase off their own affiliate link, and has purchased
any product and service from /or NANACAST.COM AND INTERNET BUSINESS IDEAS INC.from their own affiliate link,
/or NANACAST.COM AND INTERNET
BUSINESS IDEAS INC.may
ban the affiliate from participation in the affiliate program.
If an affiliate attempts to deceive Livemark Associates L.L.C.
and/or NANACAST.COM AND INTERNET BUSINESS IDEAS INC.by registering for an affiliate
account under an alias, personal, or business name, and then
uses another alias, personal, or business identity to make a
purchase using their affiliate link in order to commit
deception they will be in violation of these terms and their
account will be terminated and the commission on that sale is
forfeited. If an affiliate attempts to use a third party, such
as family member, friend, employee, or associate, to register
as an affiliate for the sole purpose of allowing them to then
purchase off the cooperating parties affiliate link so that
the cooperating party may then return the affiliate commission
to the person attempting to circumvent this agreement and
deceive /or NANACAST.COM AND
INTERNET BUSINESS IDEAS INC., then the commission credited the cooperating
party shall be forfeited and /or NANACAST.COM AND INTERNET BUSINESS IDEAS INC.may, at their discretion,
cancel both the cooperating affiliate party and the conspiring
purchasing party's accounts and ban them from use of products
and services provided by /or
NANACAST.COM AND INTERNET BUSINESS IDEAS INC.. If an affiliate is participating in a
two tier affiliate structure offered by /or NANACAST.COM AND INTERNET BUSINESS IDEAS INC.through related
affiliate programs, that affiliate may not join as their own
sub affiliate. The affiliate may not earn commissions on two
tiers from an individual sale. Attempts to deceive and defraud
/or NANACAST.COM AND INTERNET
BUSINESS IDEAS INC.in
this manner may result in the deletion of the affiliate
account and the banning of the affiliate and the forfeit of
all commissions associated with that account at the discretion
of /or NANACAST.COM AND
INTERNET BUSINESS IDEAS INC..
If an affiliate participating in a two tier affiliate
structure offered by /or
NANACAST.COM AND INTERNET BUSINESS IDEAS INC.attempts to register a family member,
friend, employee, or close associate in their second tier and
then uses the affiliate link of that family member, friend,
employee, associate in their own promotions as a way to
"double dip" or obtain commission payments on two levels they
will be considered as attempting to deceive and defraud
/or NANACAST.COM AND INTERNET
BUSINESS IDEAS INC.which may result in the deletion of the affiliate account and
the banning of the affiliate and the forfeit of all
commissions associated with that account at the discretion of
/or NANACAST.COM AND INTERNET
BUSINESS IDEAS INC..
6. Affiliates may not promote /or NANACAST.COM AND INTERNET BUSINESS IDEAS INC.. and their associated
publishers via unsolicited email (UCE) at any time. Affiliates
may not promote /or
NANACAST.COM AND INTERNET BUSINESS IDEAS INC. and their associated publishers via any form
of spam including spam email, spam forum posts, instant
message spam, social networking site spam, comment spam on
blogs and social networking sites, help desk spam, IP to IP
message spam, and any other method that is not authorized by
the recipient or host of such advertising. Email advertising
is strictly prohibited except to subscribers who have
specifically opted into an email newsletter, announcement
system, service, or other subscriber management system that is
owned and controlled by the affiliate or a company owned by
the affiliate and only when the subscriber has specifically
opted in knowingly entering into a subscriber or customer
relationship with the affiliate and authorized them to send
them information including promotional offers. Affiliates must
comply with all state, local, federal, and international bulk
email, email communication, commercial email, and privacy laws
and must be CAN-SPAM compliant. Affiliates may not promote
/or NANACAST.COM AND INTERNET
BUSINESS IDEAS INC.,
their publishers and related products and services via email
to any group of email subscribers that was purchased or
obtained from a third party such as leads, co-op, and bulk
email lists. If any affiliate is found to be in violation of
these terms they will be held liable for civil damages by
/or NANACAST.COM AND INTERNET
BUSINESS IDEAS INC. and
they will be reported to the proper government and legal
agencies.
7. Affiliates must abide by local, state, federal, and
international advertising laws and refrain from making
unsubstantiated earnings claims, faking endorsements, and may
not imply that /or NANACAST.COM
AND INTERNET BUSINESS IDEAS INC. and their publishers endorse them, their
business, or their related websites. If any affiliate is found
to be in violation of these terms they will be held liable for
civil damages by /or
NANACAST.COM AND INTERNET BUSINESS IDEAS INC. and they will be reported to the proper
government and legal agencies.
8. Affiliates may not use graphics, sales copy, ad copy,
and other copyrighted materials owned by /or NANACAST.COM AND INTERNET BUSINESS IDEAS INC. and publishers using
their system without the express authorization and consent of
the copyright holder. Affiliates may not use copyrighted
materials owned by any third parties without prior consent and
authorization for the purpose of promoting /or NANACAST.COM AND INTERNET BUSINESS
IDEAS INC. and their
publishers. If any affiliate is found to be in violation of
these terms they will be held liable for civil damages by
/or NANACAST.COM AND INTERNET
BUSINESS IDEAS INC. and
they will be reported to the proper government and legal
agencies.
As an affiliate, you agree to these terms and any affiliate
found to be in violation of these terms is subject to
immediate termination, forfeit of commissions, and will be

The following are terms and conditions for joining and
promoting the affiliate program for NANACAST.COM AND INTERNET
BUSINESS IDEAS INC.
memberships. They DO NOT apply to any affiliate relationship
having to do with promoting NANACAST.COM AND INTERNET BUSINESS
IDEAS INC. podcasts or
podcasts published by our publishers. (See Above)
1.
I authorize
NANACAST.COM AND INTERNET BUSINESS IDEAS INC.to share my contact information with the
publishers of our sister site, Nanacast.com for payment
purposes only. I understand that this is to enable publishers
of Nancast.com, whose affiliate program I have joined, to send
me commission payments.
2. I understand the fact that commissions are paid on the
following schedule:
a. For a FREE Account, you make
nothing, BUT, the FREE user is cookied and IP matched to your
affiliate link If/when they upgrade, you will be credited for
the sale and start earning commissions.
b. For a PROFESSIONAL Account, you will be paid $10.00 USD
for each month that particular person retains an account with
NANACAST.COM AND INTERNET BUSINESS IDEAS INC.. If they upgrade, you will receive the
higher commission. If they downgrade, you will receive the
commission for that account level. If they cancel their
account, your commissions will cease.
c. For a VIRAL Account, you will be paid $30.00 USD for
each month that particular person retains an account with
NANACAST.COM AND INTERNET BUSINESS IDEAS INC.. If they downgrade, you will receive the
commission for that account level. If they cancel their
account, your commissions will cease.
d. Commissions will be paid on or near the first of each
month for the month prior.
e. Commissions will be paid through PayPal and by other
means if requested.
3. No affiliate may purchase our products or services or
the products and services of our publishers through their own
link. If an affiliate is discovered to have joined as an
affiliate for the purpose of purchasing goods and services
from /or NANACAST.COM AND
INTERNET BUSINESS IDEAS INC., or from our publishers they will not be paid
